Who is Liable for a Dog Bite in Connecticut?

In the state of Connecticut, dog owners and caregivers are held strictly liable for injuries their dog should inflict to another person or their property. Unlike other states that implement “one bite” rules, a dog owners in Connecticut can be held liable even if they had no knowledge that their dog posed a threat to another person or had never bitten anyone before.

Dog owners and caregivers are held liable for injuries a dog causes if:

  • The injury is to the person or property of another
  • The person who was injured was not trespassing
  • The injured person was not abusing, tormenting, or otherwise provoking the dog

Children under the age of seven cannot ordinarily be found guilty of trespassing or provoking a dog, unless the defendant can prove otherwise. This statute also applies to other injuries a dog may cause other than from being bitten. Injuries that are caused by a dog jumping, scratching, or knocking down another person are also covered under Connecticut’s “dog bite” law. Injured parties must file a claim within two years of suffering an injury in order to have their claim heard by the courts.

Can Other Parties Be Held Liable?

Yes! In certain circumstances, landlords can be held liable for a bite caused by a tenant’s dog if the landlord had knowledge of the dog’s viciousness and failed to make a reasonable effort to alleviate the danger the animal posed. Additionally, if a person is injured by two or more dogs owned by different people, the dog owners are jointly held liable for the damages sustained.
